These Terms of Use („Terms”) govern your use of the WX Aviation Weather mobile application and related services (the „App”), provided by Imre Virág („we”, „us”, „our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Not for operational or navigational use — safety disclaimer
The App provides aviation weather information (including METAR, TAF, NOTAM, SIGMET/AIRMET, winds and temperatures aloft, PIREP, and related data) and optional weather-change notifications for general informational and situational-awareness purposes only.
• The App is not a certified source of aeronautical information and must not be used as the sole or primary basis for flight planning, navigation, or any in-flight decision.
• Weather and aeronautical data may be delayed, incomplete, interrupted, or inaccurate, and are provided by third-party sources (e.g., aviation weather providers and government agencies).
• Before every flight you must obtain an official weather briefing and current NOTAMs from an authorized source, and comply with all applicable regulations.
• You, as pilot in command, are solely responsible for the safe conduct of your flight and for all go/no-go decisions.
2. Weather Alerts (push notifications)
Weather Alerts are an optional convenience feature that may notify you of changes in reported conditions at airports you choose to monitor. Alerts depend on third-party data, network availability, device settings, and timely delivery by Apple’s Push Notification service, and may be delayed, missed, or inaccurate. You must never rely on receiving (or not receiving) an alert. Alerts do not replace an official weather briefing.
3. Subscriptions, billing, and Family Sharing
Certain features (the „Weather Alerts” subscription) are offered as an auto-renewable subscription purchased through your Apple Account.
• Billing: payment is charged to your Apple Account at confirmation of purchase.
• Auto-renewal: the subscription automatically renews for the same period unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• Free trial (if offered): any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing / cancelling: you can view, manage, or cancel your subscription in your Apple Account settings, or via the „Manage subscription” option in the App.
• Family Sharing: the subscription is eligible for Apple Family Sharing and may be shared with members of your Family Group in accordance with Apple’s rules.
• Prices may change; we will seek your consent for price increases where required, and price changes do not affect the period already paid for.
• Purchases are also subject to Apple’s applicable terms, including the Apple Media Services Terms and Conditions.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use, subject to these Terms and Apple’s Licensed Application End User License Agreement (the „Apple Standard EULA”).
5. Acceptable use
You agree not to: reverse engineer, decompile, or attempt to extract source code except as permitted by law; interfere with or disrupt the App or its servers; use automated means to access the service beyond normal use; or use the App in any way that violates applicable law or the rights of others.
6. Intellectual property
The App, its content, and design are owned by us or our licensors and are protected by intellectual-property laws. Weather and aeronautical data remain the property of their respective providers. No rights are granted except as expressly stated.
7. Third-party data and services
The App relies on third-party data sources and on Apple’s services. We do not control and are not responsible for the availability, accuracy, or content of third-party data, and their terms may apply.
8. Disclaimer of warranties
The App and all data are provided „as is” and „as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, timeliness, or non-interruption, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages, or for any loss arising from reliance on the App or its data, or from any delay, error, or unavailability of alerts or data. Nothing in these Terms limits liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, or for fraud). Your statutory consumer rights are not affected.
10. Changes
We may update the App and these Terms from time to time. Material changes will be indicated by updating the „Last updated” date. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Hungary and applicable European Union law, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection provisions of your country of residence.
